General Terms and Conditions CO₂ Compensation Certificates

1 Scope of application

V-ZUG AG, Industriestrasse 66, 6300 Zug (“V-ZUG”) is the operator and responsible for the website https://co2.vzug.com (the “Website”). On the Website, users can calculate their CO₂ equivalent emissions based on the use of V-ZUG household appliances and offset them by purchasing CO₂ compensation certificates from “V-Forest”. For this purpose, a formula is used which enables the CO₂ emissions of certain V-ZUG household appliances to be determined over their entire service life on the basis of the Swiss electricity mix and electricity consumption values of the appliances. In addition, other activities such as flights, car journeys or similar can be compensated. The sale of CO₂ compensation certificates is a service provided by V-ZUG (the “Service”).

Through the purchase of CO₂ compensation certificates of “V-Forest”, measures for the purpose of offsetting CO₂ emissions are financially supported, currently a reforestation project in Scotland of the RipaGar Foundation. The amount of CO₂ to be compensated is calculated or can be freely chosen and can be seen on the CO₂ compensation certificate, which is sent to the user as an attachment in the confirmation email.

The provisions of these general terms and conditions (the “General Terms and Conditions V-Forest”) apply exclusively to the service described herein. 

2 Costs of using the service

The use of individual services, in particular the implementation of the CO₂ compensation measure, may incur costs that are to be borne exclusively by the user. The description of the service, costs and information on payment can be found by the user in the context of the respective service.

3 Warranty

V-ZUG makes no warranties or representations that the Website will be uninterrupted or available at any particular time. V-ZUG is not liable for the correctness of the information made available by third parties and the information in brochures regarding the emissions caused.

V-ZUG’s liability is excluded if and to the extent permitted by law. To the extent that V-ZUG’s liability cannot be excluded by law or by contract, the amount of liability shall be limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract (value of the performance determined).

The above limitations of liability shall also apply in favor of V-ZUG’s corporate bodies, representatives and vicarious agents. Liability for loss of profit, unrealized savings, recourse claims of third parties, damages resulting from interruption of operations as well as for all indirect and consequential damages is excluded.

4 Amendment of the “General Terms and Conditions CO₂ Compensation Certificates”

V-ZUG AG reserves the right to amend these “General Terms and Conditions CO₂ Compensation Certificates” at any time.

5 Data Protection

The purchase of CO₂ compensation certificates requires the processing of the following personal data by V-ZUG: E-mail address, first and last name, address and place of residence as well as credit card details.

6 Final provisions

Should one or more provisions of these Terms of Use be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions.

Swiss law shall apply exclusively. To the extent legally permissible, the courts at V-ZUG’s registered office shall have exclusive jurisdiction over any disputes arising out of or in connection with this Agreement. V-ZUG reserves the right to assert claims against a user at the user’s place of residence.
